STUWEB.CO.UK Terms of Service for Participants and Non-Organisers

StuWeb.co.uk allows event organisers to setup an online event registration service to then promote, share and sell entries to their event(s). The payments of event entries are processed via a payment gateway. STUWEB RACE ENTRIES Ltd is NOT an Event Organiser and is not responsible for the Events and Memberships listed on the stuweb.co.uk Service. All enquiries regarding any Events or Memberships listed on stuweb.co.uk should be directed to the Organiser located on each event page.

1. Acceptance of Terms

1. Overview The following Terms of Service (TOS) govern all use by you as a Participant (a Person/Entity registering and purchasing an Entry or Membership on the STUWEB.CO.UK System) and Non-Organiser (Person/Entity using and sharing information on the STUWEB.CO.UK Service) and STUWEB.CO.UK (a service by StuWeb Event Services Limited). The Services are owned and operated by STUWEB.CO.UK. The Services are offered subject to your acceptance without modification of all of the Terms and Conditions contained herein and all other operations rules, policies and procedures that may be published from time to time on STUWEB.CO.UK (the Site) by STUWEB.CO.UK. STUWEB.CO.UK is not responsible for the Content published by Organisers on the STUWEB.CO.UK Service (the Service) and you agree to use the Service at your own risk.

2. Modification STUWEB.CO.UK reserves the right, to modify or replace any of the terms or conditions of this TOS at any time. It is your responsibility to check this TOS periodically for changes. Your continued use of the Services following the posting of any changes to this TOS constitutes acceptance of those changes. It is your responsibility to cease accessing, browsing and using the Services, If any change to this TOS is not acceptable to you.

3. You agree to use the Services only for purposes that are permitted by (i) the Terms of Service and (ii) any applicable law, regulation or generally accepted practices or guidelines in the relevant jurisdictions.

2. Your use of the Service

1. The Service STUWEB.CO.UK hereby grants you right to access and use the Service for the purpose of browsing Events, share Events Information, registering for Events and paying for Event products and services. You shall not be permitted or permit anyone else to, directly or indirectly: (a) modify, reproduce or create derivatives of any part of the Service or STUWEB.CO.UK site content; (b) resell, distribute or act as agent of STUWEB.CO.UK unless expressly authorised by STUWEB.CO.UK.

2. The Events contracting parties By entering an event or completing a membership form on STUWEB.CO.UK, a sales contract is created between the Buyer and STUWEB.CO.UK which is valid up to 7 working days after the conclusion of your entry or expiry of your membership. After this period the sales contract with STUWEB.CO.UK is concluded and any further communication shall be between the Buyer and the Organiser, unless otherwise informed by STUWEB.CO.UK. The Buyer hereby agrees to indemnify and absolve STUWEB.CO.UK with regard to any outside or third party costs the Buyer might incur for the purposes of participation of the purchased Event or membership, included but not limited to travel, accommodation, subsistence or equipment,STUWEB.CO.UK is not liable for Organiser insolvency or for the failure of an Event.

3. The Organisers Terms and Conditions The Organiser will set their own Terms and Conditions for their Events and Memberships. These Terms and Conditions will not supersede any of the STUWEB.CO.UK TOS and your purchase Terms and Conditions.

3. Event information and Conclusion of the Contract

1. Event information Event and membership information, availability, pricing, organiser terms and conditions and refund policy is the sole responsibility of the organiser. STUWEB.CO.UK has no influence regarding this information. It is the organiser's duty to ensure the validity of this information.

2. Conclusion of the Contract By proceeding to a payment gateway after selecting an event or membership the Buyer accepts the offer for the conclusion of the purchase contract. In order to accept the offer, the Buyer is required to have filled out all the necessary fields and to have accepted the organiser's terms and conditions and the STUWEB.CO.UK terms and conditions.

3. The Distance Selling Regulations Under the Consumer Protection (Distance Selling) Regulations 2000 Act, the Buyer has a cancellation period of 7 working days, from the day of purchase, in which to withdraw from the contract unless an event is due within 7 days in which case the Buyer agrees the tickets are non refundable.

4. STUWEB.CO.UK has the right to cancel the purchase contract if the Buyer has violated the conditions of the pre-sale, which have been stated by the Organiser or STUWEB.CO.UK. The declaration of withdrawal can also be provided implied by refunding any payments made by the Buyer.

4. Payment

1. Payment STUWEB.CO.UK will collect the Event and Membership Fees on behalf of the Organiser and deducts all applicable Services Fees from the Event Registration Fees collected by STUWEB.CO.UK, and then pass the remainder along to the Organiser after an agreed period. STUWEB.CO.UK reserves the right to withhold funds (a) if and when STUWEB.CO.UK determines it to be necessary for the processing and settlement of all refunds, disputed charges, chargebacks, Buyers complaints, allegations of fraud, and other discrepancies and (b) as otherwise permitted pursuant to this TOS. STUWEB.CO.UK will NOT transfer any money to the Organiser if an Event is cancelled.

2. Credit Cards STUWEB.CO.UK does NOT store any card details for your payment. The payment is handled directly by the payment provider and STUWEB.CO.UK is informed of the outcome of the transaction.

3. Refunds If you cancel your entry within the terms of the organiser then any refund due under those terms will only be refunded by the same payment method as the original transaction. If the refund is for one of many entries then only the relevant entry will be refunded.

5. Service Modification/Suspension STUWEB.CO.UK reserves the right, at any time, to modify, suspend or discontinue, temporarily or permanently STUWEB.CO.UK (or any part thereof) for any reason or no reason with or without notice. You agree that STUWEB.CO.UK shall not be liable to you or any third party for any modification, suspension or discontinued service.

6. Links STUWEB.CO.UK allows for Organisers to insert links to other internet websites or resources. Because STUWEB.CO.UK has no control over such websites and resources, the Buyer or any other user of the STUWEB.CO.UK service, agrees that STUWEB.CO.UK is not responsible, endorses or liable for any external content available on such websites or resources. You or any other user of the STUWEB.CO.UK service agrees that STUWEB.CO.UK is not responsible or liable for any consequences arising from the usage or reliance of any such websites or resources.

7. Liability

1. STUWEB.CO.UK is NOT liable for any injury of life, body or health, based on a violation of duty by Organisers, its legal agents or its vicarious agents.

2. The Buyer absolves STUWEB.CO.UK of any responsibility for anything relating to the Event or Membership placed by the Organiser on the STUWEB.CO.UK System.

3. Any claims from the Buyer, relating to anything stemming from the purchase of an Event or Membership, should be made to the Organiser.

8. Protection of Privacy (Events)

1. By accepting the STUWEB.CO.UK TOS the Buyer is declaring that: (a) they allow their personal data (NOT their Payment Information), to be used by the Organiser and STUWEB.CO.UK for the purposes of Event participation logistics and Membership Administration only. If you wish to opt in to marketing information from the event organiser or STUWEB.CO.UK this will be availalable on the entry form and can be changed at any time by the registered user.

9. Protection of Privacy (Memberships)

1. By accepting the STUWEB.CO.UK TOS the Buyer is declaring that: (a) they allow their personal data (NOT their Payment Information), to be used by the Club and STUWEB.CO.UK for the purposes of Membership logistics only. If you wish to opt in to marketing information from the event organiser or STUWEB.CO.UK this will be availalable on the membership form and can be changed at any time by the registered user.

10. Protection of Privacy (All)

1. STUWEB.CO.UK does not store Credit Card details on any of its servers.

2. STUWEB.CO.UK may offer or require you to register for an account. It is your responsibility to ensure that all registration information you provide will always be valid, correct, and up to date. You are responsible for maintaining the security of your account and password. Accounts registered by bots or other automated methods are not permitted

3. You agree to STUWEB.CO.UK's privacy policy, as available below.

11. Disclaimer of Warranties

The STUWEB.CO.UK service is provided on an "as is" and "as available" basis. STUWEB.CO.UK makes no

warranty that: (a) The Service will meet your requirements (b) The Service will be uninterrupted, timely, secure or error free (c) The results from the use of the service will be reliable or accurate (d) The Service or Events (or any part thereof) will meet your expectations (e) Any error will be corrected.
